Lula offers both consumer services, where consumers can shop at local convenience stores (“Consumer Services”) and business services such as analytics, advertisements, inventory management, and an e-commerce platform (“Business Services”) for such stores.
Personally Identifiable Information (PII): Any information about an individual or entity, including any information that can be used to distinguish or trace an individual’s identity, such as name, address, email address, telephone number and demographic information, such as age, gender, and interests, that you voluntarily give Lula in your use of the Service.
2. DATA WE COLLECT
We may collect and store information about you in connection with your use of Consumer or Business Services, including any information you provide, transmit, or as a function of providing the Service to you. We use that information to perform and enhance the Service’s functionality and quality, fulfill your requests, research and analyze the Service, personalize your Service experience, track usage of the Service, provide feedback to Business Services users, display relevant advertising, market Consumer or Business Services, provide customer support and communicate with you. We also utilize this information or Data to secure our Service, Consumer and Business Services, back up our systems, allow for disaster recovery, and comply with any legal obligations. Although all Data or information may not be retained, it is transmitted to our US – based servers initially and stored long enough to provide the Service, Consumer and Business Services.
a. Account Information: If you create a Lula account, we may store and use the information you provide during that process, such as your full name, user name, email address, phone number, address, date of birth, PII or other information you may provide such as your gender, profile picture, device location, or contacts. You can modify some of the information associated with your account through your account settings.
b. Data Collected While Using Consumer Services: If you opt-in and when you interact with, or use, the Service, you have the option to provide your geo-location data. We do not use this data for any other purpose than to provide Services to you. You may choose to not share your location with us.
c. Third Parties: We may receive or provide Data about you to third parties, including those that provide services to you, us or that interact with the Service to better enhance the experience for you.
If you created your account using your Google, Twitter or Facebook account profile, we may receive certain information from these companies, such as your first name, last name, gender, birthday, email address, and your Google, Twitter, or Facebook ID, which we will use for the purposes of constructing your Lula user account and to sign you in to Lula.
d. Contacts: You can invite others to join or become your friend on Lula by providing us with their contact information, or by allowing us to access your contacts from your mobile device or third-party sites such as Facebook, Twitter, or Google, to select which individuals you want to invite. If you allow us to access your contacts, we will encrypt and transmit that information to our servers, storing information from users you choose to invite to the Service, but only keeping other information long enough to process your invitations.
3. HOW DATA IS USED
a. To Operate, Maintain, and Improve the Service: We may use your Data to perform the Service, maintain the Service, and to better understand you and tailor the Consumer and Business Services to you.
We may also use your Data for internal research and development, to improve the Service, to offer new products, features and tools, or to suggest that you friend another user, but only to the extent that this is in compliance with applicable law.
Additionally, if you consent to sharing crash data (should the app crash) with us, we may use that Data to help us analyze the cause of the crash and improve our Service.
b. Communicate With You: We may use your Data to communicate with you, including by email, text (only if you opt-in), or in our app, about new product offerings, updates to the Services, or anything else we think may be of interest to you. You can opt-out of:
a. push notifications by adjusting your device settings;
b. emails by clicking the unsubscribe link in the footer of our messages;
c. text messages at any time through the app or replying STOP or NO to the message itself.
4. HOW DATA IS SHARED
a. Consumer Services: Certain information about convenience stores is collected with the intention to share publicly and is therefore viewable to the public. A convenience store’s name, location and hours of operation are shared publicly. We share the name, address, and phone number of users of Consumer Services to perform Consumer Services. Some of the other activity through Consumer Services, like how you rate businesses, where you check-in or where your friends check-in on your behalf, which contributions or users you follow, and which businesses you bookmark is also shared publicly. You can limit the public nature of some of these activities through your account settings.
b. With Third Party Partners And Service Providers: We may share PII with third party partners and/or service providers who act on our behalf to enable the Consumer Services, Business Services, and Service to function (e.g., hosting platforms, email programs, and other essential services), and we may also share information, but only in aggregate form, with a Business Services customer.
We share your PII, notably email address, with an advertising agency to perform advertising functions on our behalf. We do not share your PII with third parties for their own marketing purposes.
5. DATA RETENTION AND ACCOUNT TERMINATION
We may engage service providers to perform certain tasks on our behalf, such as storing data, including PII, in connection with your use of the Service. However, when you close your account with us, we will remove PII provided and dissociate public posts and previously purchased items from your account profile, but we may retain information provided to the app, such as previously purchased items, for the purpose of maintaining the purpose and functionality of the Service. We may also retain information to prevent, investigate, or identify possible wrongdoing in connection with the Service or to comply with legal obligations.
You may close your Lula account within the app by navigating to Settings – Account – Delete Account. After deleting your account, a Lula representative may reach out to you via email to solicit feedback about your experience with the Service.
6. DO NOT TRACK SIGNALS
We do not respond to “Do Not Track” Signals.
The Service is intended for general audiences and is not directed to children under 13. No one under age 13 may provide any information on our app or website. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information without parental consent, please contact us at firstname.lastname@example.org. If we become aware that a child under 13 has provided us with personal information without parental consent, we will take steps to remove such information and terminate the child's account.
